There is a real possiblity that comprehensive lawsuit reform will be on the table this year in Oklahoma. House Bill 1603 seeks to reduce the number of frivolous lawsuits in Oklahoma and the bill passed the state's House Committee in February 2009. The bill aims to cap non-economic damages, require an top-rated witness for pre-certification of a lawsuit and eliminate joint and several liability.
Passage of this bill by the state Senate will mean that the measures will be voted on by the citizens of Oklahoma and will not require the signature of Gov. Brad Henry. As has been demonstrated in other states - practical, common sense malpractice reforms lead to improved access to healthcare for citizens and lower malpractice rates for doctors.
